These Regulations further amend the Tonnage Tax (Training Requirement) Regulations 2000 by increasing the amount of the payments which fall to be made in lieu of training and which are payable to the Maritime Training Trust. Payments are to be made in lieu of training where the training commitment of a company or group provides for such payments, or where the company or group does not provide training in accordance with the training commitment.
Civil Procedure (Amendment No. 2) Rules 2017

These Rules amend the Civil Procedure Rules 1998 (SI 1998/3132), by—amending Part 3 to make clear the court’s power to require proceedings to be heard before a Divisional Court of the High Court;amending Part 47 to refer to provision now made by Practice Direction 47;amending Part 52 to include a reference to the Social Services and Well-being (Wales) Act 2014 and to make clear that “rolled-up” hearings of applications for permission to appeal and the appeal remain possible;amending Part 59 to reflect the change of name of the Mercantile Court to the Circuit Commercial Court and making consequential amendments to Parts 30, 52, 61 and 62;amending Part 78 to give effect to changes in the EU Regulation establishing a European small claims procedure;amending Part 83 to require the court’s permission for issue of a writ of possession to enforce a notice of eviction under the Immigration Act 2014 (c. 22) as amended.
Goods Vehicles (Licensing of Operators) (Amendment) Regulations 2017

These Regulations make amendments to the Goods Vehicles (Licensing of Operators) Regulations 1995 (S.I. 1995/2869) (“the principal Regulations”) which, with the exception of those made by regulations 3(c), 4 and 10, are consequential on the making of related legislation, in particular Regulation (EC) No. 1071/2009 of 21st October 2009 which established common rules concerning the conditions to be complied with to pursue the occupation of road transport operator (“Regulation 1071/2009”) and the provisions of the Road Transport Operator Regulations 2011 (S.I. 2011/2632) which give effect to that Regulation in relation to Great Britain and make consequential changes to the Goods Vehicles (Licensing of Operators) Act 1995 (c. 23) (“the 1995 Act”).

These Regulations transpose Commission Directive 2015/719 amending Council Directive 96/53/EC (“the EU Directive”) by amending the Road Vehicles (Authorised Weight) Regulations 1998 (S.I. 1998/3111) and the Road Vehicles (Construction and Use) Regulations 1986 (S.I. 1986/1078) (the “1986 Regulations”) in relation to the maximum authorised dimensions and weights of heavy goods vehicles and buses in national and international traffic where those vehicles use alternative fuel technology.
Bournemouth, Dorset and Poole (Structural Changes) Order 2018

This Order provides for the establishment, on 1st April 2019, of a single tier of local government for a new local government area comprising the existing Boroughs of Bournemouth, Christchurch and Poole and a single tier of local government for the remainder of the county of Dorset (articles 3 and 7). The counties and boroughs of Bournemouth and Poole, the county of Dorset and the districts in the county of Dorset are abolished on 1st April 2019.

Immigration (Alcohol Licensing and Late Hours Catering) (Scotland) Regulations 2018

These Regulations extend to Scotland and are made under section 36 of the Immigration Act 2016 (c. 19) (“the 2016 Act”), which allows regulations to make provision for Scotland which has similar effect to that which Schedule 4 to the 2016 Act makes for England and Wales. Schedule 4 to the 2016 Act makes amendments to the Licensing Act 2003 (c. 17) relating to illegal working. These Regulations make similar effect by amending the Licensing (Scotland) Act 2005 (asp 16) (“the 2005 Act”) and the Civic Government (Scotland) Act 1982 (c. 45) (“the 1982 Act”). These Regulations place restrictions on the holding of alcohol or late night catering licences by people who are not entitled to work in the United Kingdom, or people who have been convicted of immigration offences or required to pay immigration penalties.
Welsh Ministers (Transfer of Functions) Order 2018

Justification of Practices Involving Ionising Radiation (Amendment) Regulations 2018

These Regulations are part of a package of measures to transpose Council Directive 2013/59/Euratom (OJ No. L13, 17.1.2014) laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation, and repealing Directives 89/618/Euratom, 90/641/Euratom, 96/29/Euratom, 97/43/Euratom and 2003/122/Euratom. The Regulations extend to the whole of the United Kingdom.
Police, Fire and Crime Commissioner for Essex (Fire and Rescue Authority) Order 2018

This Order makes provision for the creation of a fire and rescue authority under section 4A of the Fire and Rescue Services Act 2004 (c. 21) for the areas of the councils of the boroughs of Southend-on-Sea and Thurrock and Essex County Council. The person who is for the time being the police and crime commissioner for Essex is to be for the time being the Authority (see article 3) and will be known as the Police, Fire and Crime Commissioner for Essex. The Authority will be known as the Essex Police, Fire and Crime Commissioner Fire and Rescue Authority (“the Authority”). The Essex Fire Authority is abolished (see article 17).
United Nations and European Union Financial Sanctions (Linking) (Amendment) Regulations 2017

These Regulations amend the United Nations and European Union Financial Sanctions (Linking) Regulations 2017 (S.I. 2017/478) (“the 2017 Regulations”) to refer to Council Regulation (EU) 2017/1509 of 30th August 2017 concerning restrictive measures against the Democratic People’s Republic of Korea (OJ L 224 31.8.2017, p. 1) as it repeals and replaces Council Regulation (EC) No. 329/2007 (OJ L 88 29.3.2007, p. 1) to which the 2017 Regulations previously referred.
Operation of Public Service Vehicles (Partnership) (Amendment) Regulations 2017

Electronic Communications (Broadband) (Universal Service) Order 2018

These Rules amend the Special Immigration Appeals Commission (Procedure) Rules 2003 (S.I. 2003/1034) (“the 2003 Rules”) as a consequence of the commencement of—section 66 of the Criminal Justice and Courts Act 2015 (c. 2) which inserts new sections 7B-7D in the Special Immigration Appeals Commission Act 1997 (“the 1997 Act”) which enable ‘leapfrog’ appeals directly from the Special Immigration Appeals Commission (“the Commission”) to the Supreme Court; andthe immigration bail provisions in Schedule 10 to the Immigration Act 2016 (c. 19) (“the 2016 Act”).
Fire and Rescue Authority (Police and Crime Commissioner) (Application of Local Policing Provisions, Inspection, Powers to Trade and Consequential Amendments) Order 2018

Radioactive Contaminated Land (Enabling Powers and Modification of Enactments) (England) (Amendment) Regulations 2018

These Regulations are part of a package of measures to transpose Council Directive 2013/59/Euratom of 5 December 2013 (“the Directive”) laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation, and repealing Directives 89/618/Euratom, 90/641/Euratom, 96/29/Euratom, 97/43/Euratom and 2003/122/Euratom. Most of the transposition measures are being dealt with by amending or replacing existing statutory instruments. These Regulations transpose some requirements in Article 73(1) of the Directive as well as making amendments to reflect new definitions in the Directive.

Immigration (Guidance on Detention of Vulnerable Persons) Regulations 2018

These Regulations bring into force revised guidance specifying matters to be taken into account in determining whether a person would be particularly vulnerable to harm if that person were to be detained or to remain in detention and, if so, whether that person should be detained or remain in detention.
Short-term Holding Facility Rules 2018

Short-term holding facilities are places either used solely for the detention of immigration detainees for a period of not more than seven days (or, in the case of a holding room, for a period of not more than 24 hours unless a longer period is authorised) or used for the detention of immigration detainees for not more than seven days or for such other period as may be prescribed and for other persons for any period. These Rules make provision for the regulation and management of short-term holding facilities, including the treatment of detained persons and the conduct and duties of officers in the facility. The Rules provide for matters such as the admission and discharge of detained persons, their welfare, food, clothing, accommodation, recreation and religious observance, correspondence, visits, health care and any complaints they may wish to make, as well as the use of security measures such as powers of search.
Animals (Scientific Procedures) Act 1986 (Fees) Order 2018

Detention Centre (Amendment) Rules 2018

These Rules amend rule 35 of the Detention Centre Rules 2001. Rule 35 is amended to include a definition of ‘torture’ for the purposes of immigration detention.
Education (Student Support) (Revocation, Amendment and Saving Provision) Regulations 2018

These Regulations revoke the Education (Student Support) (Amendment) Regulations 2018 (S.I. 2018/136) and amend the Education (Student Support) Regulations 2011 (S.I. 2011/1986), in order to return the latter regulations to the state they were in before the former regulations were made. In doing so, regulation 3 of these Regulations includes a saving provision for persons who have already made an application for support in respect of a dental profession subject or postgraduate pre-registration course, and whose applications have been received by the Secretary of State by the time these Regulations come into force. The Department will lay new regulations to replace the revoked the Education (Student Support) (Amendment) Regulations 2018.
Civil Aviation (Investigation of Air Accidents and Incidents) Regulations 2018

These Regulations revoke and replace (see regulation 5) the Civil Aviation (Investigation of Air Accidents and Incidents) Regulations 1996 (S.I. 1996/2798) and the Civil Aviation (Investigation of Military Air Accidents at Civil Aerodromes) Regulations 2005 (S.I. 2005/2693). They make consequential amendments to the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013 (S.I. 2013/1471) (“RIDDOR”) in order to ensure that injuries arising from air accidents which are required to be notified to the Air Accidents Investigation Branch continue to be excluded from the relevant notification and reporting requirements in RIDDOR.
Enterprise Act 2002 (Share of Supply Test) (Amendment) Order 2018

This Order amends section 23 of the Enterprise Act 2002 (c. 40) (the Act) which sets out the criteria for a merger to be a “relevant merger situation”, thereby qualifying it for investigation by the Competition and Markets Authority. The Secretary of State has the power under section 42 of the Act to intervene in a “relevant merger situation” on the grounds of specified public interest considerations, where appropriate.
Personal Protective Equipment (Enforcement) Regulations 2018

Social Security (Contributions) (Re-rating) Consequential Amendment Regulations 2018

These Regulations amend the Social Security (Contributions) Regulations 2001 (S.I. 2001/1004) (“the Contributions Regulations”) with effect from 6th April 2018. They are made in consequence of annual regulations setting the rate at which Class 2 National Insurance contributions are payable and which are made under section 141 of the Social Security Administration Act 1992 (c. 5) and section 129 of the Social Security Administration (Northern Ireland) Act 1992 (c. 8).
Energy Performance of Buildings (England and Wales) (Amendment) Regulations 2018

Child Safeguarding Practice Review and Relevant Agency (England) Regulations 2018

Further to sections 16A to 16Q of the Children Act 2004 inserted by the Children and Social Work Act 2017, these Regulations make provision relating to the functions of the Child Safeguarding Practice Review Panel (in connection with section 16B(1)) and local safeguarding partners (in connection with section 16F(1)). The safeguarding partners for each local authority area are the local authority, clinical commissioning group and chief officer of police. The Regulations also specify relevant agencies for the purposes of section 16E(3) of the Act.

Police Super-complaints (Criteria for the Making and Revocation of Designations) Regulations 2018

Regulation 3 of these Regulations specifies the criteria which the Secretary of State must apply in deciding whether to designate a body under section 29B of the Police Reform Act 2002 (c. 30) (“the 2002 Act”). Section 29B was inserted by section 26 of the Policing and Crime Act 2017 (c. 3) (“the 2017 Act”). Bodies designated under section 29B will be able to make super-complaints under section 29A of the 2002 Act (as inserted by section 25 of the 2017 Act), being complaints about systemic issues in policing which are significantly harming the interests of the public.

These Regulations, which apply to Great Britain, revoke and replace the Renewable Heat Incentive Scheme Regulations 2011 (the “2011 Regulations”), which established a renewable heat incentive scheme (“the Scheme”). These Regulations re-enact the 2011 Regulations with amendments. The premise of the Scheme remains the same: owners of plants which generate heat from specified renewable sources and meet specified criteria may receive payments at prescribed tariffs for the heat used for eligible purposes. Payments may also be made to biomethane producers who produce biomethane for injection. The Regulations confer functions on the Gas and Electricity Markets Authority (“the Authority”) in connection with the administration of the Scheme.

These Regulations provide for the Secretary of State to give a direction (a “security direction”) in response to certain types of urgent security threat. The Secretary of State may direct those persons responsible for a civil nuclear site, nuclear or other radioactive material stored on part of a nuclear site, a nuclear construction site or other nuclear premises, the transport of nuclear material, or those persons holding sensitive nuclear information or equipment or software relating to uranium enrichment. The power to direct arises where the Secretary of State is satisfied that those premises or that material or information is at risk from an imminent threat of terrorism, espionage, sabotage or theft. It also arises where the Secretary of State is satisfied that there is an imminent threat of sensitive nuclear information or equipment or software relating to uranium enrichment being compromised or disclosed.

These Regulations implement Regulation (EU) 2017/2392 of the European Parliament and of the Council of 13 December 2017 amending Directive 2003/87/EC to continue current limitations of scope for aviation activities and to prepare to implement a global market based measure from 2021. Directive 2003/87/EC (“the Directive”) is currently implemented in the UK by the Greenhouse Gas Emissions Trading Scheme Regulations 2012 (“the 2012 Regulations”). The 2012 Regulations require aircraft operators which fall within the scope of the EU Emissions Trading Scheme and are administered by the UK to monitor and report their aviation emissions each calendar year and then to surrender sufficient emissions trading allowances to cover those emissions. These Regulations amend the 2012 Regulations.

These Regulations make various amendments to the Income Tax (Pay As You Earn) Regulations 2003 (S.I. 2003/2682) (“The PAYE Regulations”). In particular consequential amendments are made following a rate resolution made by the Scottish Parliament on 20 February 2018 under section 80C of the Scotland Act 1998 introducing two new bands for income tax for the tax year 2018-19 for Scottish taxpayers – the starter rate (which is lower than the Scottish basic rate) and the intermediate rate (which is in between the Scottish basic rate and Scottish higher rate).
