This Order makes consequential and transitional arrangements in relation to the devolution of landfill tax to Wales. Specifically, it makes amendments to the Landfill Tax Regulations 1996 (S.I. 1996/1527) (“LFTR 1996”) to reflect the fact that landfill tax will no longer be charged in Wales with effect from the day on which sections 18 and 19 of the Wales Act 2014 (c. 29) come into force (the “commencement date”). The amendments made by this Order will come into force on the commencement date.

These Regulations amend the Criminal Legal Aid (Remuneration) Regulations 2013 (S.I. 2013/435; the “2013 Regulations”). The Regulations amend the legal aid fees that are payable to advocates in criminal proceedings under the advocates’ graduated fee scheme (“AGFS”), as set out in Schedule 1 to the 2013 Regulations. The Regulations make provision for advocates’ fees to be determined according to a new banding structure for criminal offences.

These Regulations impose obligations on trustees or managers of certain occupational pension schemes in relation to the disclosure of information about transaction costs and charges imposed on members by those schemes. These Regulations implement the duty on the Secretary of State imposed by section 113 of the Pension Schemes Act 1993 (c. 48), as amended by section 44 of the Pensions Act 2014 (c.19), to make regulations requiring the giving and publication of information about administration charges and transaction costs. In addition, they impose obligations concerning the disclosure of information about the pooled funds in which assets are invested by the scheme on behalf of members.

These Regulations are made by way of powers in the Education and Skills Act 2008. Their purpose is to revoke and replace the Education (Independent Educational Provision in England) (Inspection Fees) Regulations 2009 (“the 2009 Regulations”) (S.I. 2009/1607), which have been the main piece of legislation in this area. In addition, these Regulations make amendments to the Education (Independent School Standards) Regulations 2014 (2014/3283).

They provide rules for calculating in respect of a billing authority in England all or part of whose area falls within a designated area—the billing authority’s non-domestic rating income in respect of the designated area for a specified year; andthe proportion of that non-domestic rating income that is to be disregarded for the purpose of specified calculations under Schedule 7B to the 1988 Act.

These Regulations implement the International Convention on Load Lines, 1966, as modified by the Protocol of 1988 relating to the Convention. The Regulations also implement all amendments to the Convention and Protocol as at the date of this statutory instrument. All future amendments to Annexes I, II and III to the Convention will be automatically incorporated into the Regulations by way of ambulatory reference (regulation 5). The Regulations apply the provisions of the Convention, with certain limited exceptions, to United Kingdom ships and to non-United Kingdom ships in United Kingdom waters meeting the size or weight criteria in the Convention, including ships from countries which are not parties to the Convention, and which are engaged on international voyages.

The obligations under the Freedom of Information Act 2000 (c. 36) (“the Act”) apply to public authorities. Section 3(1) provides that a “public authority” includes a body or office which is listed in Schedule 1 to the Act. The Minister for the Cabinet Office may add bodies and office holders to Schedule 1 by an order under section 4(1), provided that the conditions in section 4(2) and (3) are satisfied. By section 4(6), an order under section 4(1) may relate to a specified person or office or to persons or offices falling within a specified description.

These Regulations implement the revised version of Annex II of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 (“the MARPOL Convention”). Annex II contains regulations for the Control of Pollution by Noxious Liquid Substances in Bulk. As a consequence of these Regulations, the Merchant Shipping (Dangerous or Noxious Liquid Substances in Bulk) Regulations 1996 (S.I. 1996/3010) and amending instruments (S.I. 1998/1153 and S.I. 2004/930) which implemented the previous version of Annex II, are revoked. Other consequential amendments and partial revocations are also made. Future amendments of provisions of the Convention and other instruments specified in these Regulations will be automatically incorporated into the Regulations by way of ambulatory reference (regulation 4).

Part 1 of Schedule 3B of the Police Reform Act 2002 (c. 30) sets out a list of powers that are reserved solely for use by constables, and cannot be used by civilians employed by police forces, or police volunteers, and designated with police powers under section 38 of that Act. These Regulations insert an additional power of a constable into the list of reserved powers in Part 1 of Schedule 3B. The power of a constable to be added into Part 1 of Schedule 3B is the power to conduct an intimate search under section 55(6) of the Police and Criminal Evidence Act 1984 (c. 60) where an officer of at least the rank of Inspector considers it not practicable for a suitably qualified person to conduct such a search.

Armed Forces Act (Continuation) Order 2018

Section 382 of the Armed Forces Act 2006 (“the 2006 Act”) provides that the 2006 Act will expire at the end of one year beginning with the day on which the Armed Forces Act 2016 (“the 2016 Act”) was passed, unless continued in force by Order in Council in accordance with that section. The 2016 Act was passed on 12th May 2016. The Armed Forces Act (Continuation) Order 2017 (S.I. 2017/569) provided for the continuation of the 2006 Act for a period of 12 months. This Order provides for the continuation of the 2006 Act for a further period of 12 months. It provides so that the 2006 Act expires at the end of 11th May 2019.

The Board of the Pension Protection Fund (“the Board”) is established by section 107 of the Pensions Act 2004 (c. 35) (“the 2004 Act”) to provide compensation for members of certain occupational pension schemes in the event of the insolvency of the scheme’s sponsoring employer, where the pension scheme is underfunded below a certain level. The compensation payable to individual members is determined in accordance with Schedule 7 to the 2004 Act and regulations made under it, including the Pension Protection Fund (Compensation) Regulations 2005 (S.I. 2005/670) (“the Compensation Regulations”).
