These Regulations are made under Part 4A of the Police Act 1996 (the “1996 Act”), which was inserted by section 30 of, and Schedule 8 to, the Policing and Crime Act 2017. Part 4A of the 1996 Act requires the College of Policing to maintain two lists; the police barred list (see section 88B) and the police advisory list (see section 88J). These Regulations are made under various powers in Part 4A to make provision supplementing the regime established under that Part.

These Regulations amend the Recovery of Costs (Remand to Youth Detention Accommodation) Regulations 2013 (S.I. 2013/507) by transferring the power of the Youth Justice Board for England and Wales to recover the cost of a night of remand to youth detention accommodation to the Secretary of State. These Regulations provide for a transition period between 18th December 2017 and 17th December 2018 to allow for the effective transfer of the administrative arrangements associated with the cost recovery process. During that time the Youth Justice Board for England and Wales and the Secretary of State can both issue invoices to seek to recover the cost of a night of accommodation for remand to youth detention accommodation. The local authority is only liable to pay one of these bodies (either the Youth Justice Board for England and Wales or the Secretary of State).

These Regulations amend the Cultural Test (Television Programmes) Regulations 2013 (the “2013 Regulations”), which set out the conditions that must be satisfied before the Secretary of State can certify a television programme as a British programme under Part 15A of the Corporation Tax Act 2009 (c. 4) (the “2009 Act”). Certification as a British programme is a condition of eligibility for television tax relief under that Act.

The Order also amends the maximum criminal fine for loss of communication with Air Traffic Control and corrects defects in the 2016 Order.

That information relates to the fixed and variable costs involved in operating the local services in the franchising authority’s area and to the vehicles used by the operator in providing those local services, including information about the age of those vehicles and about relevant requirements concerning emissions and types of fuel or power.

These Regulations prohibit the use of microbeads as an ingredient in the manufacture of rinse-off personal care products and the sale of any such products containing microbeads (regulation 3). Breach of these prohibitions is an offence (regulation 3). (Definitions of “microbead” and “rinse-off personal care product” are contained in regulation 2.) The prohibition on the manufacture of such products comes into force 21 days after these Regulations are made and the prohibition on the sale of any such products comes into force 6 months after the day on which these Regulations are made.

The Local Government Finance Act 1988 provides for non-domestic hereditaments to be revalued every 5 years. On a revaluation new non-domestic rating lists are compiled showing the updated rateable values of all hereditaments. The last compilation date was 1st April 2017. The Non-Domestic Rating (Renewable Energy Projects) Regulations 2013 (“the 2013 Regulations”) operate on the basis that any increase in rateable value from 31st March 2013 can be attributed to a change in the hereditament or its use. The effect of the revaluation is that, from 1st April 2017, hereditaments may have seen changes in rateable value compared with 31st March 2013 without there necessarily having been a change to the hereditament.

Section 7(3) of the Misuse of Drugs Act 1971 requires regulations to be made to allow the use for medical purposes of the drugs which are subject to control under that Act. Section 7(3) does not apply to any drug designated by order under section 7(4) as a drug to which section 7(4) is to apply. This Order amends the Misuse of Drugs (Designation) (England, Wales and Scotland) Order 2015 by inserting the drug known as methiopropamine or MPA into Part 1 of the Schedule to that Order.

These Regulations amend the Misuse of Drugs Regulations 2001 (“the Regulations”). The schedule to the Regulations in which a controlled drug is placed primarily affects the extent to which the drug can be lawfully imported, exported, produced, supplied or possessed and dictates the record keeping, labelling and destruction requirements in relation to that drug. The controlled drugs placed in Schedule 1 to the Regulations are those subject to the tightest controls.

Section 84 of the Pension Schemes Act 1993 (c. 48) (“the 1993 Act”) requires pensions and other benefits under occupational pension schemes to be revalued by the final salary method (which is dealt with in Schedule 3 to that Act). For the purposes of that revaluation and, as required by paragraph 2 of Schedule 3 to the 1993 Act, this Order specifies the necessary revaluation percentages for the purpose of the revaluation on or after 1st January 2018 of benefits under occupational pension schemes. It is not necessary to specify a lower revaluation percentage for revaluation periods which start before 1st January 2009.
Insolvency (England and Wales) and Insolvency (Scotland) (Miscellaneous and Consequential Amendments) Rules 2017

Part 1 of these Rules amends provisions in the Insolvency (England and Wales) Rules 2016 (“the 2016 Rules”), which came into force on 6 April 2017. The purpose of these amendments is to effect minor corrections and clarifications. Rule 7 has a more substantive effect in that it inserts a new provision reflecting the Practice Direction supplementing Section IV of CPR Part 6, for service of a statutory demand outside of the jurisdiction. Rule 8 enables the court to decline to a file a bankruptcy petition if the creditor has not satisfied the requirement to bring the debtor’s attention to the statutory demand.

These Regulations amend the Individual Savings Account Regulations 1998 (S.I. 1998/1870) (“the ISA Regulations”) to allow the savings of a deceased person in an Individual Savings Account to continue to benefit from tax advantages during the administration of the estate (regulations 4 and 9).
