Guidance: Trade Unions’ Registers of Members: the Certification Officer’s powers of investigation and enforcement

The Transparency of Lobbying, Non-party Campaigning and Trade Union Administration Act 2014 gives the Certification Officer additional powers with respect to investigating and enforcing the compliance of trade unions with their duties to maintain a register of members under the Trade Union and Labour Relations (Consolidation) Act 1992.

This guidance details the Certification Officer’s powers of investigation and enforcement. It sets out: (i) who can approach the Certification Officer with concerns; (ii) how concerns are dealt with, including issues of confidentiality; and (iii) eventual outcomes in terms of an order or declaration.

These powers come into force on 1 June 2016.
