Publication of the New Best Listing Practice Guidance for Domestic Abuse Cases

New Domestic Abuse Best Listing guidance has been published today, ahead of the Scheme coming into effect on 4 January 2027.

Operating within the National Listing Framework, the Scheme will support a more consistent approach to the progression of suitable domestic abuse cases across the Magistrates’ courts and Crown Court in England and Wales. It provides an expedited listing and case-management pathway designed to reduce avoidable delay, provide greater certainty for victims and defendants, and support the fair, safe and timely resolution of cases.

This guidance will apply to all cases falling within the Scheme charged on or after 4 January 2027.

The guidance builds on existing court processes, with an emphasis on early identification, effective preparation and robust case management. Close collaboration between the judiciary, HMCTS, CPS, Police, Probation and practitioners will be central to the approach, helping to ensure that every hearing counts.

“Domestic abuse cases require careful and effective case management. This new guidance will support a more consistent approach to listing and progressing suitable cases, helping to reduce avoidable delay and provide greater certainty for complainants, victims and defendants.

“I am grateful to all those across the criminal justice system who have contributed to developing the guidance and supporting its implementation, under the leadership of Mrs Justice Knowles, who deserves special thanks.”

The Rt Hon the Baroness Carr of Walton-on-the-HillLady Chief Justice of England and Wales

The new guidance, together with the executive summary, is available here.
