On 7 and 8 December 2006 I heard an appeal from the costs capping order made in this libel action by Master Campbell on 29 September. I had the valuable assistance of Senior Costs Judge Hurst as an assessor and I am most grateful to him. The nature of the exercise is, in accordance with modern practice, one of review rather than rehearing. What is more, although reference has been made to changed circumstances since submissions were made to Master Campbell (in writing) during the summer, there is no application before me for a variation or revision of the order for that reason. Nor could there be, since it would need to be made to a costs judge on notice to the other side.
