Open consultation: HS2 Phase 2a Additional Provision 2 Environmental Statement and Supplementary Environmental Statement 2 Consultation (February 2019)

In July 2017, the government deposited a Bill in Parliament seeking powers to construct, operate and maintain the second phase of the High Speed Two (HS2) railway, between the West Midlands and Crewe, known as ‘Phase 2a’. In March 2018, the government proposed a number of changes to the High Speed Rail (West Midlands – Crewe) Bill in Parliament in a set of documents known as Additional Provision 1 (AP1). This was accompanied by a Supplementary Environmental Statement (SES1). The government has now deposited a second AP (AP2), which proposes further changes to the Bill, along with an Environmental Statement (AP2 ES) and a second Supplementary Environmental Statement (SES2).

Additional Provisions are a normal part of the Parliamentary passage of large projects such as HS2. The changes proposed in AP2 reflect our discussions with landowners, occupiers and stakeholders, refinements to the design and updated environmental information.

We are seeking your views on:

Additional Provision 2 Environmental Statement (AP2 ES), which reports on the likely significant environmental effects of the amendments in AP2 i.e. amendments to the High Speed Rail (West Midlands to Crewe) Bill which are outside the existing powers and limits of the Bill. Supplementary Environmental Statement 2 (SES2) which sets out the likely significant environmental effects of the construction and operation of the railway. This is based on updated environmental information and changes to the design and construction assumptions within the existing powers and limits of the High Speed Rail (West Midlands to Crewe) Bill.

Your responses to the consultation on SES2 and AP2 ES will be assessed by Parliament’s independent assessor who will then publish a report on the issues raised in response to the consultation to inform MPs consideration of the Bill at Third Reading.

How to respond

The consultation will close at 11:45pm on 29 March 2019. Email responses can be submitted until 11:45pm on the final day of the consultation. Paper responses must be posted on or before the final day of the consultation.

Confidentiality and data protection

The Department for Transport (DfT) and High Speed Two (HS2) Limited are joint data controllers for the purpose of the consultation of the ES and SES.

The DfT is a data controller as the Secretary of State for Transport is the sponsor of the High Speed Rail (West Midlands to Crewe) Bill (the Bill). HS2 Ltd is a controller in managing the day-to -day matters in delivering the Phase 2a project and in managing the contract with Ipsos MORI. Ipsos MORI is a data processer in managing the consultation information received.

The consultation is carried out in compliance with the requirements of the House of Commons and House of Lords standing order 224A for private business.

Under this order, the Secretary of State is required to deposit the comments (including personal data) received to the Private Bill office and to submit the comments to the Independent Assessor.

The processing is necessary in the exercise of official authority vested in DfT and HS2, as controllers. The Secretary of State for Transport is the sponsor of the Bill which will authorise the construction and operation of the high speed railway from the West Midlands to Crewe. The consultation on the ES and SES is an essential prerequisite for the Bill to proceed within the parliamentary process.

The privacy notices of the Department for Transport and HS2 Ltd contain more information about your rights in relation to your personal data, how to complain and how to contact the respective Data Protection Officers. Personal data contained within the comments will be kept securely until after the Bill has received Royal Assent.
